Waiver & Assumption of Risk

Combat sports carry real physical risk. Every participant at DKM Academy — including free trial guests — must read, understand and sign our waiver before training. This page reproduces its substance so you know exactly what you are agreeing to before you arrive.

1. Nature of the Activities

DKM Academy offers boxing, kickboxing, Muay Thai, pad work, bag work, partner drills, strength and conditioning, and — for authorized participants only — supervised sparring. These are contact and high-exertion activities.

2. Assumption of Risk

I understand and voluntarily accept that participation involves inherent and unavoidable risks that cannot be eliminated regardless of the care taken. These risks include, without limitation: bruises, cuts, sprains and strains; broken bones and dental injuries; joint, ligament, muscle and tendon damage; eye injuries; concussion and other head, neck and spinal injuries; heat exhaustion, cardiac events and other medical emergencies; permanent disability; and death.

I further accept risks arising from equipment failure or misuse, slips and falls, contact with floors, walls, ropes, bags or equipment, the actions or inaction of training partners, other participants, coaches or spectators, and the transmission of communicable illness.

I am participating of my own free will, with full knowledge of these risks, and I assume them entirely.

3. Fitness and Medical Representation

I confirm that I am in good physical health and have no medical condition, injury, pregnancy or medication that would make participation unsafe, or that I have disclosed such matters to DKM Academy in writing and have obtained clearance from my physician.

I agree to immediately stop training and inform a coach if I feel unwell, dizzy, faint, disoriented, or take a hard blow to the head. I understand that DKM Academy is not a medical provider and does not diagnose or treat injuries.

I consent to DKM Academy arranging emergency medical assistance on my behalf if I am unable to do so, and I accept responsibility for the cost of that care.

4. Release, Waiver and Indemnity

To the fullest extent permitted by the laws of Ontario, I release, waive, discharge and agree not to sue DKM Academy (Diyako Martial Arts Academy), its owners, directors, coaches, instructors, employees, volunteers, contractors, landlords and affiliates (the "Released Parties") from any and all claims, demands, actions, costs and liabilities of any kind arising out of or connected with my participation in any activity, class, event, seminar or use of the premises or equipment — including claims arising from the ordinary negligence of the Released Parties.

I agree to indemnify and hold harmless the Released Parties from any claim brought by or on behalf of me, my family, or a third party as a result of my conduct or participation.

This release binds me, my heirs, executors, administrators and assigns. Nothing in this release purports to waive liability that cannot lawfully be excluded, including gross negligence, wilful misconduct, or any right that cannot be waived under applicable Ontario or Canadian law. If any part of this release is held unenforceable, the remainder continues in full effect.

5. Minors (Ages 7–15)

A parent or legal guardian must read, complete and sign the waiver on behalf of any participant under the age of 18. By signing, the guardian confirms authority to do so, accepts the risks described above on the minor's behalf, and agrees to the release and indemnity to the extent permitted by law.

Guardians must remain reachable by phone for the full duration of a minor's class and must provide accurate emergency contact information.

6. Sparring Policy

Sparring is never mandatory. It is permitted only for participants a head coach has cleared, only during coach-supervised sessions, and only with the required protective equipment — including mouthguard, hand wraps, appropriate gloves, shin guards where applicable, and headgear when directed.

Controlled intensity is enforced. Any participant who ignores intensity limits, targets an unwilling partner, or continues after being told to stop may be removed from the floor and have their membership terminated without refund.

7. Rules of the Facility

Follow all coach instructions at all times.

No training while intoxicated or impaired.

No unsupervised use of the ring, bags or equipment.

Report every injury, however minor, to a coach immediately.

Personal property is brought onto the premises at your own risk; DKM Academy is not responsible for loss, theft or damage.

8. Media Consent

Photos and video may be captured during training and events and may be used for promotional purposes. Participants who do not wish to appear may opt out in writing at any time and we will accommodate the request.

9. Acknowledgement

The signed waiver executed at our facility is the operative legal document. This page is provided for transparency and does not replace it. If you have questions about anything here, ask before you sign — we would rather explain it twice than have you agree to something you do not understand.
